Lasting Powers of Attorney are deeds that can be used to appoint one or more trusted people to act as your attorneys, if you ever lost capacity to manage your own affairs. This could be as a result of dementia, being ill or having had an accident and being admitted to hospital. A Lasting Power of Attorney could also be useful if you are ever out of the country in the medium- to long-term.
There are two different types of Lasting Power of Attorney:
Lasting Power of Attorney for Property and Financial Affairs
A Lasting Power of Attorney for Property and Financial Affairs gives your attorneys power to deal with your finances, much as you do yourself. They would have power to run your bank accounts, pay bills and even to buy or sell your house. You can decide whether the deed may be used immediately, with your consent, or whether it would only come into force if you lost capacity.
Lasting Power of Attorney for Health and Welfare
A Lasting Power of Attorney for Health and Welfare can be used to empower your attorneys to make decisions about personal matters relating to your health and personal care, including decisions such as where you live, your medication and daily routine, or moving into a home. Very importantly, you will also have the opportunity to choose whether or not to give power to your attorneys to give or refuse life-sustaining treatment on your behalf. If you do not give your attorneys this power, your doctors would need to make this type of decision on your behalf, if you were unable to do so yourself. A Lasting Power of Attorney for Health and Welfare can only be used once the person has lost the ability to make this type of decision for themselves, and not before.
Clients usually make both types of Lasting Power of Attorney at once, because their roles are completely different.
Enduring Power of Attorney
If you already have in place an old-style Enduring Power of Attorney, it will still be valid. However, you may like to think about putting in place a Lasting Power of Attorney for Health and Welfare to sit alongside it, because the Enduring Power of Attorney only gives your attorneys power to make decisions about financial matters, and not decisions relating to your health and welfare.
